Foreclosure Definition & Meaning

Foreclosure is a legal process through which a lender takes possession of a mortgaged property when the borrower fails to make mortgage payments as agreed upon in the loan contract. In simpler terms, it is the process by which a lender reclaims a property from a borrower who has defaulted on their mortgage.

Here's an overview of the foreclosure process:

  • Default: The process usually begins when the borrower fails to make one or more mortgage payments. This is known as defaulting on the loan.
  • Notice of Default: After a period of missed payments, the lender typically sends a notice of default to the borrower. This notice informs the borrower that they are in violation of the terms of the mortgage and that foreclosure proceedings may begin if the default is not addressed.
  • Pre-foreclosure Period: In some cases, there may be a pre-foreclosure period during which the borrower has the opportunity to bring the mortgage current by paying the overdue amount.
  • Foreclosure Auction: If the borrower doesn't remedy the default, the lender can initiate foreclosure proceedings. The property is usually auctioned off, and the highest bidder becomes the new owner. This process may vary depending on local laws and regulations.
  • Realization of Loss or Surplus: The proceeds from the foreclosure auction are used to satisfy the outstanding mortgage debt. If the sale amount exceeds the debt, the remaining funds may go to the borrower. If there is a shortfall, the lender may seek to recover the remaining amount through other means.

Foreclosure laws and procedures vary by jurisdiction, and they can be influenced by factors such as the type of mortgage, local regulations, and whether the foreclosure process is judicial or non-judicial.
